General Terms and Conditions
이해를 돕기 위해 이용 약관은 영어로 표시됩니다. 내용이 서로 다를 경우 독일어판이 구속력을 가집니다(§22 (3)).
§1 Scope, contracting party and agent
(1) These terms apply to all contracts for city tours, guided tours, tour guiding and shore excursions (hereinafter “tours”) booked via MeinReiseleiter.de.
(2) The customer’s contracting party (hereinafter “provider”) is a) for tours in Turkey: TATİLEGO TURİZM SEYAHAT İŞLETMELERİ SANAYİ VE TİCARET LİMİTED ŞİRKETİ (Condor Travel), TÜRSAB licence no. 14400, İkiçeşmelik Mah. Süleyman Demirel Bul. Melis Apartmanları Sitesi Melis Apartmanı B Blok No: 21B İç Kapı No: 6, Kuşadası/Aydın, Turkey, phone +90 256 614 67 87, info@condortravel.com.tr; b) for tours in Germany: Besch Berufsbekleidung und Reise Unternehmen UG (haftungsbeschränkt), Hauptstraße 44, 39164 Schleibnitz, Germany.
(3) For tours in Turkey, Besch Berufsbekleidung und Reise Unternehmen UG (haftungsbeschränkt), Hauptstraße 44, 39164 Schleibnitz (hereinafter “agent”), acts exclusively as representative in the name and for the account of the provider under paragraph 2 a). It is authorised to receive bookings, declarations and payments on behalf of the provider. No separate contract on the performance of the tour is concluded between the customer and the agent. Declarations made by the customer to the agent are deemed received by the provider.
(4) The tours are individual tourist services of less than 24 hours without overnight stay. They are not package tours within the meaning of § 651a of the German Civil Code (BGB); the provisions of package travel law do not apply.
(5) Anyone booking a tour for further participants is liable for the contractual obligations of all registered participants as for their own, provided they expressly declared this at the time of booking. They ensure that all participants know these terms.
(6) If a travel agency, agency or company books for third parties, the booking party is the provider’s contracting party.
(7) Deviating terms of the customer do not apply unless the provider expressly agrees to them in text form.
§2 Subject of the contract and third-party services
(1) The subject of the contract is exclusively the performance of private or group tours in accordance with the respective service description and the booking confirmation. Only the services stated there are owed.
(2) Guiding fee and vehicle are stated separately. A vehicle with driver is part of the contract only if expressly booked and stated in the booking confirmation.
(3) Third-party services, in particular entrance fees, transfers, catering, ship cruises, boat tours, yacht trips, tickets and events, are not part of the contract unless expressly stated in the booking confirmation. If such services are arranged at the customer’s request, the provider acts merely as an intermediary; the respective service provider becomes the contracting party. The latter’s terms apply to arranged services, in particular its payment and cancellation terms. The provider informs the customer of these terms as far as known to it.
(4) Entrance fees, transfer costs, meals, tips and personal expenses are never included in the tour price and are paid on site.
(5) Tours in Turkey are carried out by the provider under §1 paragraph 2 a) with licensed guides. The agent may act as guide himself; this does not change the contracting parties under §1.
(6) MuseumPass cards and entrance, event and other third-party tickets sold or arranged by the provider are non-refundable, non-exchangeable and non-transferable to another period once issued or transmitted to the customer; the issuer’s terms apply. This also applies in case of cancellation or non-attendance of the tour. By ordering, the customer expressly agrees that issuance takes place immediately and confirms knowledge that any right of withdrawal thereby expires.
§3 Conclusion of the contract
(1) The presentation of services on the website does not constitute a binding offer. Offers of the provider are non-binding until the booking confirmation is issued.
(2) With the booking, the customer makes a binding offer. The contract is concluded upon receipt of the provider’s booking confirmation in text form; an e-mail is sufficient.
(3) The provider is not obliged to accept a booking, in particular if no guide in the requested language or no suitable vehicle is available.
(4) The customer checks the booking confirmation immediately for correctness, in particular date, time, meeting point, number of persons and language, and reports discrepancies within 48 hours. Discrepancies reported later are treated as a change request by the customer.
(5) The contract language is German.
§4 Prices, surcharges and taxes
(1) The price agreed at the time of booking applies. It changes only if the customer subsequently requests additional services or increases the number of persons.
(2) The base price applies to the number of persons stated in the service description. For each additional person the surcharges stated there apply. A reduction in the number of persons after conclusion of the contract does not reduce the base price.
(3) For a tour start from 14:00 and until 06:00 the provider charges a surcharge of 50 percent on the guiding fee. Vehicle and transfer prices remain unaffected.
(4) Transfers are never included in the tour price; they are charged separately and stated in the booking confirmation.
(5) Additional services requested by the customer on site, in particular extension of the tour, additional driving distances or waiting times, are charged subsequently at the stated hourly or kilometre rates and are due immediately.
(6) The stated prices are final prices. For tours performed outside Germany no German VAT is shown, because the place of performance is where the tour takes place.
(7) Fees of the customer’s bank or payment service provider, in particular for international transfers and currency conversion, are borne by the customer.
§5 Payment and default
(1) Payment methods are bank transfer, credit card and PayPal. Payments for tours in Turkey are made by the customer with debt-discharging effect to the agent, who receives them as the provider’s authorised collection agent. If agreed in the booking confirmation, the balance may also be paid in cash on site at the start of the tour. The deposit must always be paid by bank transfer, credit card or PayPal.
(2) For bookings 30 days or more before the date, a deposit of 30 percent is due upon conclusion of the contract; the balance is due no later than 14 days before the date, or at the start of the tour if cash payment is agreed.
(3) For bookings less than 30 days before the date, the total price is due immediately; if cash payment is agreed, the deposit is due immediately and the balance at the start of the tour.
(4) Cash payment is made in euros or, by agreement, in local currency at the amount stated in the booking confirmation. The customer receives a receipt.
(5) Participation requires full payment. If a balance due at the start of the tour is not paid, the provider may refuse to perform the tour; the cancellation fees under §9 for no-show apply.
(6) If the customer fails to make a payment due before the date despite a reminder and a grace period of five days, the provider may withdraw from the contract and allocate the tour elsewhere. In this case the cancellation fees under §9 at the time of withdrawal apply; the customer may prove that a lower damage occurred.
(7) With the booking confirmation the customer receives the service contract for the booked tour. The customer receives a receipt for payments made.
(8) Set-off is permitted only with undisputed or legally established claims.
§6 Customer’s cooperation, suitability, travel documents
(1) Before conclusion of the contract the customer communicates all circumstances relevant to planning and performance, in particular limited mobility, pushchairs, child seats, allergies relevant to booked catering, and special requests.
(2) For wheelchair-accessible tours the customer communicates the type of wheelchair, total width and weight including the person before conclusion of the contract. On this basis the provider confirms before booking whether the stated model can be transported in the intended vehicle.
(3) Information on the accessibility of individual places is based on the provider’s experience and is checked before the date. Alterations, closures and technical faults, such as defective lifts, are beyond the provider’s control. In such cases the provider offers an equivalent alternative; there is no claim for a refund in this respect.
(4) Each participant is responsible for being able to cope with the demands of the tour, in particular walking distances, stairs and weather. The provider may refuse participation if it is apparent that a participant would endanger themselves or others; the cancellation fees under §9 remain unaffected.
(5) The customer is responsible for valid travel documents, visas, entry and health regulations of the destination country and for timely arrival and departure. If the tour cannot be taken or only partially for this reason, the cancellation fees under §9 apply.
(6) If a tour cannot be performed or only to a limited extent due to incorrect or incomplete information from the customer, the cancellation fees under §9 apply. Additional costs arising from this are borne by the customer.
(7) Minors participate only accompanied by a parent or guardian or an adult authorised by them.
(8) The customer ensures that they can be reached on the day of the tour at the mobile number provided.
§7 Performance and changes to services
(1) Route, order and schedule may be adapted for objective reasons, for example construction sites, events, opening hours, official orders, security situation or traffic conditions, provided the overall character of the tour is preserved. There is no entitlement to visit a specific place if it is closed, overcrowded or inaccessible on the day of the tour; the provider offers an equivalent alternative.
(2) Tours generally take place in all weather. If the safety of participants is at risk, for example in case of an official severe weather warning, the provider may postpone the tour or offer an equivalent substitute service.
(3) The provider is entitled to deploy an equally qualified substitute guide or to provide an equivalent substitute vehicle.
(4) Times stated for tour duration and return are approximate. The provider is not responsible for delays caused by traffic, weather, strikes, security checks, waiting times at sights or the behaviour of participants.
(5) For shore excursions for cruise guests the provider plans the return with a sufficient time buffer before the last embarkation. The customer states the last embarkation time set by the ship when booking and informs the provider immediately of any changes.
§8 Late arrival of the customer
(1) After 15 minutes of waiting from the agreed meeting point and start there is no further obligation to wait. A tour shortened as a result does not give rise to a refund claim; waiting times beyond 15 minutes are counted towards the tour duration.
(2) If the customer does not appear within 30 minutes and cannot be reached by phone, the tour is deemed not started. The cancellation fees under §9 apply; proof of a lower damage remains permitted.
(3) For shore excursions for cruise guests the provider waits without surcharge as long as the ship is delayed. The tour duration is shortened accordingly so that the return before the last embarkation is ensured. If the ship does not call at the port, §11 paragraph 1 applies accordingly.
(4) For airport or hotel pick-ups the waiting time is extended only in case of a proven delay of the customer’s flight or transfer.
§9 Cancellation by the customer
(1) Cancellations must be made in text form; an e-mail to kontakt@meinreiseleiter.de is sufficient. Receipt by the provider is decisive. Cancellations by phone take effect only when confirmed by the provider in text form.
(2) Upon conclusion of the contract, guide and vehicle are firmly reserved for the customer. The provider is obliged to make cancellation payments to them. Therefore the following flat-rate cancellation fees apply, each as a percentage of the total price: up to 30 days before the date 30 percent (the deposit is not refunded), 29 to 15 days 50 percent, 14 to 7 days 75 percent, 6 to 1 day and in case of no-show 100 percent.
(3) The provider reserves the right to claim a demonstrably higher damage, in particular non-refundable cancellation payments to guides, drivers and service providers. For arranged third-party services under §2 paragraph 3 the cancellation terms of the respective service provider additionally apply; costs already advanced and non-refundable as well as tickets under §2 paragraph 6 are charged in full. The customer may prove that no damage or a substantially lower damage occurred. Saved expenses and other use of the service are credited.
(4) Cancellation of individual participants counts as partial cancellation. The base price remains unaffected; for surcharges per additional person that no longer apply, the rates under paragraph 2 apply.
(5) The provider recommends taking out travel cancellation, trip interruption and international health insurance. These are not part of the contract.
§10 Rebooking and substitute participants
(1) A one-time free rebooking to another date is possible up to 30 days before the date, subject to availability. Later rebooking requests and any further rebooking count as cancellation with new booking; the cancellation fees under §9 apply.
(2) In case of rebooking the price of the new date applies. Payments already made are credited.
(3) The customer may name a substitute participant until the start of the tour; no additional costs arise. The provider may object to the substitute participant if they do not meet the requirements of the tour or the vehicle capacity would be exceeded. Customer and substitute participant are jointly and severally liable for the price.
§11 Withdrawal by the provider
(1) In case of force majeure, official orders, travel warnings, strikes, closures, epidemics, natural events or other impossibility of performance, the provider may withdraw from the contract. Payments already made are refunded immediately and in full; there are no further claims.
(2) If the tour cannot take place for reasons on the provider’s side, for example illness of the guide or failure of the vehicle, and no substitute under §7 paragraph 3 is available, the customer receives, at their choice, an alternative date or a full refund. Further claims, in particular for reimbursement of flight, hotel or travel costs, are excluded to the extent permitted by law.
(3) For group tours with a stated minimum number of participants, the provider may withdraw up to 14 days before the date if the minimum number is not reached. Payments are refunded in full; alternatively an alternative date is offered.
(4) The provider may withdraw if the customer breaches their payment obligations under §5 or has provided incorrect information under §6.
§12 Termination and exclusion
(1) If the provider terminates the tour for reasons for which it is responsible, the price attributable to the part not performed is refunded proportionately.
(2) In case of termination due to force majeure or for safety reasons: if less than two thirds of the tour were performed, 50 percent is refunded; from two thirds onwards there is no refund.
(3) If the customer terminates the tour or does not take part in individual programme items, there is no refund claim.
(4) Participants who persistently disrupt the tour, do not follow the guide’s instructions, are visibly intoxicated or under the influence of drugs or endanger others may be excluded from the tour without a refund claim. Additional costs, for example for a return transfer, are borne by the customer.
§13 Right of withdrawal
There is no right of withdrawal for contracts for services in the field of leisure activities if the contract provides for a specific date or period (§ 312g paragraph 2 no. 9 BGB). This is the case for the tours offered. For tickets under §2 paragraph 6 the waiver agreed there applies.
§14 Liability
(1) The provider is liable without limitation for intent, gross negligence and injury to life, body or health.
(2) In case of slight negligence the provider is liable only for breach of essential contractual obligations, limited to the typical, foreseeable damage, but at most to three times the tour price.
(3) Liability under the Product Liability Act remains unaffected.
(4) The provider is not liable for merely arranged third-party services; in this respect the respective service provider is liable. This applies in particular to ships, boats, yachts, restaurants, transfer companies and venues.
(5) For loss, theft or damage of items carried, luggage and valuables the provider is liable only under paragraphs 1 and 2. Items left in the vehicle remain there at the customer’s risk.
(6) For consequential damage from delays under §7 paragraph 4, in particular missed flights, ships, trains or connecting appointments, the provider is liable only under paragraphs 1 and 2.
(7) The customer is liable for damage culpably caused by them or the participants registered by them to the vehicle, equipment or places visited.
(8) For tours in Turkey the agent is liable only for the proper arrangement and forwarding of the booking, not for the performance of the tour. The agent’s liability is limited to intent and gross negligence unless life, body or health are affected.
§15 Duties to cooperate and conduct
(1) Participants must follow the instructions of the guide and the driver, in particular for safety reasons. In road traffic and when getting in and out, participants act on their own responsibility.
(2) Alcohol and drugs during the tour are not permitted. Smoking is prohibited in the vehicle. In mosques, churches and synagogues the usual dress code applies; entry may be refused in case of non-compliance without a refund claim arising.
(3) Participants follow the house rules and photography rules of the places visited. Participants are themselves liable for violations.
§16 Complaints
(1) Complaints must be reported immediately during the tour to the guide or the provider on +49 176 62157259 so that remedy can be provided.
(2) Claims must be asserted against the provider in text form within one month after the tour date. Thereafter claims can only be asserted if the customer was prevented from meeting the deadline through no fault of their own.
§17 Photo and sound recordings
(1) Private recordings by participants are permitted as far as the places visited allow. Commercial recordings, streaming and publication of the tour or parts of it require the provider’s consent in text form.
(2) The provider makes recordings of participants only with their consent.
§18 Data protection
The provider processes the data transmitted in the course of the booking exclusively for the performance of the contract and passes it on only to the partners required for performance, such as guides, drivers and service providers. Details are contained in the privacy policy.
§19 Consumer dispute resolution
The provider is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
§20 Applicable law
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers habitually resident abroad, mandatory consumer protection provisions of the state of residence remain unaffected.
§21 Place of jurisdiction
For merchants, legal entities under public law and special funds under public law as well as for customers without a general place of jurisdiction in Germany, the place of jurisdiction is the provider’s registered office, to the extent permitted by law. For consumers the statutory place of jurisdiction applies.
§22 Final provisions
(1) Should individual provisions be or become invalid, the validity of the remaining provisions remains unaffected.
(2) Amendments and side agreements require text form.
(3) These terms are available in German, English and Turkish. In case of discrepancies the German version is binding.
